GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale govern sales made through the website atelier-christophe-r.art.

Any order placed on the website implies full and unconditional acceptance of these General Terms and Conditions of Sale.

1. Purpose

These General Terms and Conditions of Sale define the terms governing the sale of products offered by Atelier Christophe-R to individual customers and, where applicable, professional customers.

2. Products

Atelier Christophe-R offers framed rowing relief artworks created from 3D models and enhanced through manual finishing, painting, assembly and framing.

Photographs and descriptions are presented as accurately as possible. However:

  • each artwork is a handcrafted creation;
  • slight variations may exist, particularly in colours, finishes, textures and details;
  • dimensions are specified on each product page.

Such normal variations resulting from the handcrafted nature of the artwork shall not be considered defects.

3. Prices

Prices are displayed in euros.

Prices are shown without VAT. VAT not applicable under Article 293 B of the French General Tax Code.

Shipping is included within mainland France and the European Union for rowing artworks from the collection unless otherwise stated on the website.

Atelier Christophe-R reserves the right to modify prices at any time. Products are invoiced based on the price displayed at the time the order is confirmed.

4. Orders

To place an order, the customer must:

  • select the desired product(s);
  • validate the shopping cart;
  • provide the information necessary to process the order;
  • choose an available delivery method;
  • complete payment securely through Shopify Payments or any other payment method offered on the website.

The order becomes binding once payment has been confirmed.

Atelier Christophe-R reserves the right to cancel or refuse any order in the event of suspected fraud, incomplete information, obvious error, previous disputes or payment issues.

5. Shopify Payments

Payments are processed through Shopify Payments and the payment methods offered on the website. Complete banking details are not accessible to Atelier Christophe-R.

Atelier Christophe-R does not store any complete banking information.

Full payment is due at the time of ordering unless otherwise expressly agreed in writing.

6. Production and delivery

All artworks are made to order.

The estimated production time is 3 to 4 weeks before shipment unless otherwise stated on the product page or specifically communicated after the order has been placed.

Delivery terms are detailed in the Shipping Policy available on the website.

Upon delivery, the customer must inspect both the parcel and the product. In the event of visible damage, the customer is encouraged to make reservations with the carrier and contact Atelier Christophe-R within 48 hours, providing photographs and the order number.

7. Right of withdrawal

In accordance with Article L.221-18 of the French Consumer Code, consumer customers have a period of 14 days from receipt of the product to exercise their right of withdrawal without having to provide any reason.

8. Exclusions from the right of withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to products made to the customer's specifications or clearly personalised.

This includes in particular:

  • personalised artworks, including club colours or customised oar blade colours;
  • personalised texts, markings or finishes;
  • models produced upon specific request;
  • bespoke creations.

9. Return and refund conditions

Returned products must be new, unused, undamaged and properly protected.

Return shipping costs are borne by the customer unless the return results from an error by Atelier Christophe-R or a non-conforming product.

Refunds will be processed within 14 days after receipt of the returned product or proof of shipment, in accordance with applicable regulations.

10. Legal warranties

Products benefit from all applicable legal warranties, including:

  • the statutory warranty of conformity provided under Articles L.217-3 and following of the French Consumer Code;
  • the warranty against hidden defects provided under Articles 1641 and following of the French Civil Code.

11. Liability

Atelier Christophe-R shall not be liable for damage resulting from improper use of the product, incorrect handling, impact, unsuitable display conditions, inappropriate storage or unauthorised modifications to the product.

Colours displayed on screen may vary depending on the settings of the customer's device.

12. Intellectual property

The entire website, including visuals, texts, photographs, 3D models, designs and rowing relief artworks, is protected by intellectual property laws.

Any reproduction, adaptation, distribution or exploitation without prior written authorisation is prohibited.

13. Personal data

Personal data is processed in accordance with the Privacy Policy available on the website.

14. Consumer mediation

In accordance with Article L.612-1 of the French Consumer Code, consumer customers may use a consumer mediation service free of charge in the event of a dispute that has not been resolved directly with Atelier Christophe-R.

15. Governing law and disputes

These General Terms and Conditions of Sale are governed by French law.

In the event of a dispute, customers are encouraged to contact Atelier Christophe-R first in order to seek an amicable solution.

If no amicable solution can be reached, the competent courts shall be determined in accordance with the applicable legal provisions.
